Oderings Nurseries CHCH Ltd – Online Shop Terms and Conditions

 

Definitions

Customer means any person who accesses or uses the Oderings Nurseries CHCH Ltd Online Shop, including those who browse, place orders, or purchase Products through the Online Shop. This includes registered account holders and guest checkout users.

Delivery Point means the physical location at the Premises where the courier leaves the Products. This location is determined by the delivery address entered during checkout and any delivery instructions provided by the Customer. Where Authority to Leave (ATL) is provided, the location where the courier leaves the Products in accordance with those instructions is deemed to be the Delivery Point.

Dispatch means the point at which an order has been picked, packed, and handed to a courier or collected for delivery.

Fulfilment Fee means the fee charged for picking, packing, handling, and delivering an order.

Premises means the delivery address nominated by the Customer when placing an order, including the Delivery Point.

Products means goods offered for sale through the Online Shop.

We, Us, or Our means Oderings Nurseries CHCH Ltd.

 

Use of the Online Shop

Access to and use of the Online Shop is subject to these Terms and Conditions. By using the Online Shop, the Customer acknowledges they have read, understood, and accepted these Terms.

Customers are responsible for ensuring that any person using their account or payment method is authorised to do so.

Oderings Nurseries CHCH Ltd endeavours to ensure information on the Online Shop is accurate and up to date. However, we are not responsible for interruptions or errors caused by internet outages, third-party payment failures, courier disruptions, or technical system failures.

 

Orders

Orders placed through the Online Shop constitute an offer to purchase Products once payment has been successfully processed.

An order is considered received once the Online Shop records successful payment and generates an order record. Order confirmation emails are provided as a courtesy only and failure to receive a confirmation email does not invalidate the order.

Oderings Nurseries CHCH Ltd accepts an order when the Products are dispatched, or when we otherwise confirm acceptance of the order.

Orders cannot be cancelled by Customers for change-of-mind once payment has been completed. However, Customers may contact us before Dispatch to request cancellation. Where possible we may assist, but cancellation cannot be guaranteed once order processing has begun.

Oderings Nurseries CHCH Ltd may cancel an order or remove specific Products from an order where reasonable. This may occur where payment cannot be processed, where a genuine pricing or product description error has occurred, where a Product is unavailable, or where fraud or misuse of the Online Shop is reasonably suspected.

Where a Product cannot be supplied after payment but before Dispatch, Oderings Nurseries CHCH Ltd may contact the Customer to offer a substitute Product. Substitutions will only be made with the Customer’s agreement.

If the Customer declines the proposed substitute or cannot be contacted within a reasonable timeframe prior to Dispatch, the unavailable Product will be removed from the order and the Customer will be refunded the amount paid for that Product. Where the remainder of the order proceeds to Dispatch, Delivery or Fulfilment Fees will not be refunded.

If an entire order is cancelled before Dispatch due to product unavailability, the full amount paid including delivery or Fulfilment Fees will be refunded.

 

Pricing and Payment

All prices are displayed in New Zealand Dollars (NZD) and include GST unless stated otherwise.

Payment must be completed before Dispatch. Accepted payment methods include credit or debit card, Afterpay, and store credit or gift cards where applicable.

Promotions or price changes that occur after an order has been placed do not apply retroactively.

A genuine error may include an obvious pricing error, incorrect product description, incorrect image, or incorrect product availability displayed on the Online Shop. Where a genuine error occurs, Oderings Nurseries CHCH Ltd may contact the Customer to arrange a suitable outcome, which may include substitution, order adjustment, or cancellation of the affected Product.

Customers will not be charged more than the original order total unless they request a higher-value substitute and arrange additional payment.

 

Incorrect Charges

Oderings Nurseries CHCH Ltd endeavours to ensure all payments are processed correctly.

An incorrect charge may occur due to administrative or technical error. This may include, but is not limited to, incorrect manual entry of Products or pricing during phone or manually processed orders, duplicate charges, or payment processing errors.

Where an incorrect charge occurs, Oderings Nurseries CHCH Ltd will correct the error as soon as reasonably practicable. This may involve issuing a refund, adjusting the order total, or arranging payment of any outstanding balance where a genuine undercharge has occurred.

Customers will not be charged more than the original order total unless they request a change to their order or agree to purchase a higher-value substitute.

 

Afterpay

Afterpay purchases do not earn Oderings VIP Card reward points.

All Afterpay transactions are subject to Afterpay’s approval processes and terms, which are outside the control of Oderings Nurseries CHCH Ltd.

 

Product Availability and Substitution

All orders are subject to Product availability.

If a Product becomes unavailable before Dispatch, Oderings Nurseries CHCH Ltd may contact the Customer to discuss available options. These may include supplying a similar Product of comparable value, supplying an alternative Product with a price adjustment, or removing the unavailable Product from the order and issuing a refund for that Product.

Substitutions will only be made with the Customer’s agreement.

If the Customer declines a proposed substitute, the unavailable Product will be cancelled, and the Customer will receive a refund for that Product. The remainder of the order will proceed unless the Customer requests cancellation before Dispatch.

Customers will not be charged more than the original order total unless they request a higher-value substitute and arrange additional payment.

 

Plant Product Information

Plants are living products and may vary in size, shape, colour, and maturity depending on season, growing conditions, and availability.

Images displayed on the Online Shop are representative only and may not exactly match the supplied plant. Natural variation does not constitute a fault.

Some leaf drop, wilting, or minor foliage loss may occur during transit due to transplant shock. Plants may also appear dormant, less lush, or reduced in foliage during seasonal changes. These conditions are normal and do not indicate a defect.

Plant health after delivery depends on planting conditions, climate, watering, soil quality, and ongoing care. Oderings Nurseries CHCH Ltd cannot guarantee plant performance once plants are delivered and under the Customer’s care.

 

Freight and Delivery

Estimated delivery timeframes are two to four working days from Dispatch, although delays may occur due to courier or external factors.

Requests to change a delivery address must be made at least twenty-four hours before Dispatch.

Risk in the Products passes to the Customer once the Products have been delivered to the Delivery Point.

Delivery is signature required by default. Customers may request Authority to Leave (ATL). Where ATL is provided, delivery is considered complete once the courier leaves the Products at a safe and accessible Delivery Point. Oderings Nurseries CHCH Ltd is not responsible for theft, weather exposure, or damage occurring after ATL delivery.

Plants may be affected by transport conditions. Oderings Nurseries CHCH Ltd takes reasonable care to pack and dispatch plants appropriately.

Where courier damage or loss occurs, we may, at our discretion and in discussion with the Customer, arrange reshipment or provide store credit for the affected Products.

Where delivery issues occur due to customer error, including incorrect addresses, inaccessible Delivery Points, or refusal to accept delivery, redelivery may be arranged with an additional Fulfilment Fee or store credit may be issued with reasonable costs deducted.

Oderings Nurseries CHCH Ltd is not responsible for additional freight costs resulting from customer-caused delivery issues.

Where plants cannot be returned due to perishability, no credit may be issued.

 

Refunds and Returns

Refunds or exchanges are not provided for change-of-mind purchases.

If a Product is faulty, damaged, or incorrect, the Customer may be entitled to a remedy in accordance with New Zealand consumer law.

Delivery-related claims, including damaged, missing, or incorrect Products, must be reported as soon as possible and preferably within two days of delivery by contacting online@oderings.co.nz and providing the order number, a description of the issue, and photos of the Product and packaging where possible. Claims made after this period may be assessed based on product condition and plant care considerations.

 

Liability

To the maximum extent permitted by law, liability for loss arising from the supply of Products is limited to the value of the affected Product.

Oderings Nurseries CHCH Ltd is not liable for indirect or consequential losses, including plant loss due to care, environment, or conditions after delivery.

 

Force Majeure

Oderings Nurseries CHCH Ltd is not liable for delay or failure to perform obligations due to events beyond reasonable control. This includes natural disasters, severe weather, supply chain disruptions, transport interruptions, industrial action, or technical system failures.

 

Consumer Rights

Nothing in these Terms and Conditions excludes, restricts, or limits any rights or remedies available to consumers under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other applicable New Zealand consumer protection legislation.

 

Governing Law

These Terms and Conditions are governed by the laws of New Zealand.
